General Conditions and Release of Liability

Insurance and Small Groups: We reserve the right to alter any itinerary when circumstances require this, or to cancel a tour if a minimum is not reached. Please read the section on small group surcharges which apply when price-threshold minimums are not met. Also, we strongly recommend that clients take out a personal accident, baggage loss and trip cancellation insurance policy. You can compare insurance offers online at www.insuremytrip.com.

 

The tour price includes:

All ground and boat transport during the tour, double occupancy accommodations, all meals except for lunches in The Gambia, usually with an A La Carte menu, services of local guides, admission fees to nature reserves and historic properties, support vehicles and ferry costs, travel information with detailed itinerary, packing & reading list.

Health & fitness. I am aware that this is in part a walking trip, and I affirm that I am not aware of any physical, emotional or other disability that would create a hazard to myself or other tour participants. I have discussed this with my doctor, who has assured me that I am physically fit and able to undertake this trip.

Photography. I hereby agree to permit TIMBUKTOURS/BIRDS OF THE GAMBIA/FIREFINCH ADVENTURES, its agents and other guests to take photographs and make film records of this trip without further recourse. I understand and agree that such photography may be used for commercial and/or other promotional purposes.

Responsibilities. TIMBUKTOURS/BIRDS OF THE GAMBIA/FIREFINCH ADVENTURES and/or its agents give notice that all tickets or vouchers issued by them for transport or conveyance, or for hotel accommodations made by them, are made as agents for the passenger upon the express condition that they shall not be liable for any injury, damage, loss, accident, delay or irregularity which may be occasioned either by reason or defect in any vehicle, or through the acts or default of the company or person engaged in conveying the passengers, or in carrying out the arrangements of the tour or otherwise in connection therewith, or of any hotel proprietor or employee. TIMBUKTOURS/BIRDS OF THE GAMBIA/FIREFINCH ADVENTURES and/or its agents can accept no responsibility for loses or incidental expenses due to delay or change in schedules, hotel overbooking, defaults, sickness, weather, strikes, war, quarantine or other causes. All such losses or expenses will have to be borne by the passengers. The right is reserved to not accept or retain as a participant any person whose acts or conducts are judged detrimental or incompatible with the interest, comfort, harmony or well-being of the group as a whole. Baggage is at owner’s risk throughout the trip. Small items, such as cameras, coats, etc. are entirely the responsibility of the clients. The right is reserved to change or cancel any portion of the tour, and make refund accordingly. The payment of the required deposit, or any partial or full payment for a reservation for these tours shall constitute consent to all provisions contained herein.

Release and assumption of risk. In consideration of, and in part payment for, the right to participate in the trip and activities, service and food arranged for me by TIMBUKTOURS/BIRDS OF THE GAMBIA/FIREFINCH ADVENTURES and its agents and associates connected with the trip, I have and do hereby fully assume all risks of illness, injury or death, and hereby release TIMBUKTOURS/BIRDS OF THE GAMBIA/FIREFINCH ADVENTURES, and its agents and associates, from all actions and claims or demands for damages resulting from my participation in the trip. I agree that the foregoing obligation shall be binding upon me personally as well as upon my heirs, executors, and administrators and all members of my family, including any minors accompanying me. If any portion of this agreement is determined by a court to be null and void, the remaining portions of this agreement shall nevertheless remain valid and binding on the parties.

I have carefully read this agreement, and the other conditions as set out in the brochure, and fully understand its contents. I agree to all the conditions, especially noting the policy on cancellations and refunds. I am aware that this is a release of liability and a contract between me and TIMBUKTOURS/BIRDS OF THE GAMBIA/FIREFINCH ADVENTURES and/or its affiliated organizations, and I sign it of my free will and in its entirety.
